Issuing certificates for achievements, qualifications, or credentials that were not actually earned or obtained.
Impersonating educational institutions, professional bodies, government agencies, or other organizations.
Creating certificates with names, logos, seals, or trademarks without proper authorization.
Falsifying dates, signatures, credentials, or other information on certificates.
Creating certificates intended to deceive employers, institutions, or other third parties.
Backdating certificates to misrepresent when achievements occurred.
Using the Service to support any form of credential fraud.
Illegal Activities
Using the Service for any purpose that is unlawful or prohibited under applicable laws.
Violating any applicable local, state, national, or international laws or regulations.
Engaging in fraudulent, deceptive, or misleading activities.
Using certificates to obtain jobs, positions, licenses, or benefits fraudulently.
Money laundering or financing of illegal activities.
Circumventing export controls or sanctions.
Infringing on the intellectual property rights of others.
Technical Abuse
Attempting unauthorized access to our systems, networks, servers, or databases.
Using automated software, bots, scrapers, or scripts to access the Service without prior authorization.
Introducing viruses, malware, worms, trojans, or any other destructive or malicious code.

6. Subscriptions and Payment

6.2 Billing and Payment
All paid subscriptions are subject to the following terms:
Fees are charged in advance on a monthly or annual basis depending on the selected plan.
All fees are non-refundable except as expressly stated in our Refund Policy.
You are responsible for all applicable taxes, duties, and levies on your subscription.
We accept payment methods specified on our website, including credit cards, debit cards, PayPal, and bank transfers for enterprise customers.
Billing information provided must be accurate, current, and complete.
Prices are quoted in USD unless otherwise specified.
We may use third-party payment processors to process payments securely.
6.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be notified by email a reasonable period (typically 7-14 days) before renewal. If you do not agree to the new prices, you must cancel your subscription before the changes take effect.
6.5 Refund Policy
Due to the nature of our digital services, all payments are generally non-refundable. However, we may consider refund requests in the following circumstances:

We reserve the right to engage collection agencies for overdue amounts.
6.7 Plan Changes
You may upgrade or downgrade your subscription plan at any time:
Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your billing period.
Downgrades take effect at the start of your next billing period.
When downgrading, you may lose access to certain features, and data associated with those features may be deleted.
No refunds are provided for downgrades or unused portions of higher-tier subscriptions.

Templates we provide are licensed to you for use only within the Platform and for the purpose of creating certificates.
You may not copy, distribute, sell, or sublicense templates outside the Platform.

Final certificates you create using templates are considered your property for distribution purposes.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:
The amounts you paid to us during the twelve (12) months immediately preceding the incident giving rise to the claim, or
One hundred United States dollars (USD $100.00).
10.3 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
10.4 Failure of Essential Purpose
The limitations of liability set forth above shall apply even if any limited remedy specified in these Terms is found to have failed its essential purpose.
11. Indemnification
You agree to defend, indemnify, and hold harmless CertTrigger and its parent companies, subsidiaries, affiliates, directors, officers, employees, agents, licensors, service providers, contractors, and representatives from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees and legal costs) arising out of or relating to:
Your violation of these Terms or any applicable law or regulation.
Your use of the Service, including but not limited to any certificates you create, distribute, or publish.
Your violation of any law or the rights of any third party, including intellectual property, privacy, or publicity rights.
Any content you upload, post, or otherwise transmit through the Service.
Any activity conducted through your account, whether authorized by you or not.
Your negligence or willful misconduct.
Any dispute between you and any third party regarding certificates you issued.
Any claim that your content caused damage to a third party.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of such claims. You agree not to settle any matter subject to indemnification without our prior written consent.
We will make reasonable efforts to notify you of any such claim, action, or proceeding subject to this indemnification upon becoming aware of it.
12. Termination and Suspension
12.1 Termination by User
You may terminate your account at any time through:
Using the account deletion option in your account settings.
Contacting our support team at support@certtrigger.com to request account closure.
For enterprise accounts, following the termination procedures specified in your agreement.
Upon termination, you will lose access to your account and all data, certificates, and content stored within it. No refunds will be provided for any prepaid fees, and any outstanding amounts will become immediately due.
We recommend exporting any data you wish to retain before initiating account termination. Data export options are available in your account settings.
12.2 Termination by CertTrigger
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:
Violation of these Terms, including any misuse of the Service.
Request from law enforcement or other government agency.
Unexpected security or technical issues that cannot be resolved.
Extended periods of inactivity (typically 12 months or more).
Non-payment of fees due for more than 30 days.
Suspected fraudulent, abusive, or illegal activity.
Discontinuation of the Service or any part thereof.
Your bankruptcy, insolvency, or cessation of business operations.
Upon your request.
Where practicable and not prohibited by law, we will provide you with notice of termination and the reason therefor. In cases of immediate termination for cause, we may not be able to provide advance notice.
12.3 Suspension
We may temporarily suspend your access without prior notice if we reasonably believe that:
Your account has been compromised or is being used without authorization.
There is suspicious, fraudulent, or potentially illegal activity.
There is a potential violation of the Terms under investigation.
Your use is causing harm to other users or to our systems.
Suspension is necessary to comply with legal requirements.
There are outstanding payment issues that need to be resolved.
Suspension may last until the issue is resolved or until we complete our investigation. We will notify you of the suspension and the steps required to restore access when possible.
12.4 Effects of Termination
Upon termination of your account:
Your right to use the Service terminates immediately.
You must cease all use of the Service and any content obtained through it.
We may permanently delete all your data and content, though we may retain certain data for legal, regulatory, or operational purposes.
Provisions of these Terms that by their nature should survive termination will remain in effect.
You will not be entitled to any refund of fees paid.
Any licenses granted to you under these Terms will immediately terminate.
Outstanding payment obligations remain due and payable.
12.5 Surviving Provisions
The following provisions survive termination of these Terms: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should reasonably survive, including any accrued rights and obligations.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at admin@certtrigger.com. Your notice must include your name, account information, a detailed description of the dispute, and the relief you seek. We will attempt to resolve the dispute within sixty (60) days from the date of your notice. This informal dispute resolution process is a prerequisite to initiating any arbitration or court proceeding.
13.2 Binding Arbitration
If the dispute is not resolved through informal resolution within the specified period, you agree that any dispute arising from or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the rules of [Arbitration Organization, e.g., American Arbitration Association] then in effect. The arbitration shall be conducted in [City, Country], unless both parties agree to a different location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

YOU AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, OR ANY SIMILAR PROCEEDING. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS AGAINST US. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
13.4 Exceptions to Arbitration
Notwithstanding the above, each party retains the right to:
Bring an action in a court of competent jurisdiction for injunctive or equitable relief to protect intellectual property rights or prevent irreparable harm.
Pursue claims for intellectual property rights infringement in appropriate courts.
File small claims court actions in a court of competent jurisdiction for disputes within the court's monetary limits.
Seek provisional or ancillary remedies from a court of competent jurisdiction.
13.5 Time Limitation
Any claim or cause of action arising from or related to the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This limitation period is independent of any statute of limitations under applicable law.
13.6 Arbitration Rules and Procedures
The arbitration shall be governed by the procedural rules of the designated arbitration organization. In the event of any conflict between those rules and this dispute resolution provision, this provision shall govern.
14. Governing Law and Jurisdiction

16.1 Entire Agreement
These Terms, together with our Privacy Policy, Acceptable Use Policy, and any other policies or guidelines published on the Service, constitute the entire agreement between you and CertTrigger regarding the use of the Service. These Terms supersede all prior or contemporaneous agreements, representations, warranties, understandings, or negotiations, whether written or oral.
16.2 Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
16.3 No Waiver
Our failure or delay in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy. Any waiver must be in writing and signed by an authorized representative of CertTrigger to be effective. A waiver of any provision shall not constitute a waiver of any other provision or a continuing waiver.
16.4 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms to any third party without our prior written consent. Any attempted assignment without such consent shall be null and void. We may freely assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
16.5 Force Majeure
We shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, civil unrest, strikes, labor disputes, pandemics, epidemics, government actions, internet outages, power failures, telecommunications failures, or any other force majeure events.
16.6 Nature of Relationship
These Terms do not create any partnership, joint venture, agency, employment, or fiduciary relationship between you and CertTrigger. You are an independent contractor and not an employee, partner, agent, or joint venturer of CertTrigger. Neither party has any authority to bind the other or to incur obligations on the other's behalf.
16.7 Headings
The headings in these Terms are for convenience and reference only and shall not affect the interpretation or construction of any provision.
16.8 Language
These Terms are written in English, and the English version shall prevail in case of any conflict with translations. All communications and notices under these Terms shall be in English unless otherwise agreed.
16.9 Notices
All notices relating to these Terms should be sent to us via email at admin@certtrigger.com or by registered mail to our official address. We will send notices to you via the email address associated with your account or through a notice within the Service. Notices are deemed received when sent via email (upon successful transmission) or three (3) business days after mailing for postal notices.
16.10 Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms, except that our licensors and service providers may enforce applicable provisions as third-party beneficiaries.
16.11 Electronic Communications
By using the Service, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
16.12 Construction
These Terms shall not be construed against either party as the drafter. The word 'including' means 'including without limitation.' References to statutes include all regulations and amendments thereto.

Appendix A: API Terms of Use

You must keep your API keys confidential and not share them with unauthorized parties. You are responsible for all activity under your API keys.
You must comply with the rate limits specified for your subscription plan. Exceeding rate limits may result in temporary or permanent suspension of API access.
We reserve the right to suspend or terminate API access in cases of abuse, excessive use, or violation of these terms.

We may modify, suspend, or discontinue Beta Features at any time without notice or liability.
Your feedback on Beta Features helps us improve them, and we appreciate your input. By providing feedback, you grant us the right to use it without compensation.
We assume no liability for any damages resulting from your use of Beta Features.
Beta Features may not be covered by our standard support services.
Data created or processed using Beta Features may be lost when the beta period ends or features are discontinued.
You agree not to disclose information about Beta Features to third parties without our written consent.
Beta Features may be subject to usage limitations different from production features.
